Bienvenido a 333 (también conocida como ALMA). Estos Términos y Condiciones ("Términos") rigen su uso de la aplicación móvil 333 ("la App"), operada por Alama 333 ("nosotros", "nuestro" o "la Empresa").

Al descargar, instalar o usar 333, usted acepta estos Términos en su totalidad. Si no está de acuerdo, no utilice la aplicación.

1. Descripción del Servicio

333 es una plataforma de crecimiento personal y bienestar emocional que ofrece:

  • Conversaciones con ALMA, un asistente de inteligencia artificial.
  • Diario personal guiado.
  • Meditaciones y ejercicios de bienestar.
  • Seguimiento de hábitos.
  • Cursos y contenido de desarrollo personal.
  • Métricas de progreso emocional.

2. Suscripción y Pagos

2.1 Precio

333 requiere una suscripción premium con un costo de $12.99 USD al mes.

2.2 Renovación Automática

La suscripción se renueva automáticamente al final de cada periodo de facturación a menos que la cancele al menos 24 horas antes de la fecha de renovación.

2.3 Gestión de Pagos

Los pagos se procesan a través de Apple App Store o Google Play, según la plataforma de su dispositivo. No tenemos acceso directo a su información de pago.

2.4 Cancelación

Puede cancelar su suscripción en cualquier momento a través de la configuración de su cuenta en App Store o Google Play. La cancelación surtirá efecto al final del periodo de facturación en curso. No se otorgan reembolsos por periodos parciales.

2.5 Reembolsos

Los reembolsos se gestionan según las políticas de Apple o Google, según corresponda. Nosotros no procesamos reembolsos directamente.

3. Uso de Inteligencia Artificial — Aviso Importante

ALMA NO es un profesional de salud mental.

ALMA es un asistente de inteligencia artificial diseñado para acompañar su proceso de reflexión y crecimiento personal. ALMA:

  • NO proporciona asesoramiento médico, psicológico ni psiquiátrico.
  • NO sustituye la terapia profesional ni el tratamiento médico.
  • NO diagnostica ni trata condiciones de salud mental.
  • NO debe ser usada en situaciones de crisis o emergencia.

Si se encuentra en una situación de crisis, contacte a los servicios de emergencia de su país o una línea de ayuda especializada. ALMA es una herramienta complementaria de bienestar, no un sustituto de atención profesional.

4. Contenido del Usuario

4.1 Propiedad

Usted retiene todos los derechos de propiedad sobre el contenido que crea en 333, incluyendo entradas de diario, reflexiones y cualquier texto que escriba.

4.2 Licencia de Uso

Al usar la App, usted nos otorga una licencia limitada, no exclusiva y revocable para almacenar, procesar y mostrar su contenido con el único propósito de proveer el servicio. Esta licencia termina cuando elimina su cuenta.

4.3 Respuestas de IA

Las respuestas generadas por ALMA son creadas por inteligencia artificial y no representan opiniones o consejos profesionales de Alama 333. Estas respuestas se proporcionan "tal cual" sin garantía de precisión o idoneidad.

5. Uso Aceptable

Al usar 333, usted se compromete a:

  • Usar la App de acuerdo con las leyes aplicables.
  • No intentar manipular o abusar del sistema de IA.
  • No usar la App para generar contenido ilegal, dañino o abusivo.
  • No intentar acceder a cuentas de otros usuarios.
  • No realizar ingeniería inversa ni intentar extraer el código fuente.
  • No usar la App con fines comerciales no autorizados.
  • No crear múltiples cuentas para evadir restricciones.

Nos reservamos el derecho de suspender o cancelar cuentas que violen estos términos.

6. Propiedad Intelectual

6.1 Nuestra Propiedad

La App, incluyendo su diseño, código, marca, logotipos, contenido editorial, meditaciones, cursos y todos los materiales relacionados, son propiedad de Alama 333 o sus licenciantes y están protegidos por leyes de propiedad intelectual.

6.2 Restricciones

No puede copiar, modificar, distribuir, vender ni crear obras derivadas basadas en nuestro contenido o la App sin nuestro consentimiento previo por escrito.

7. Limitación de Responsabilidad

En la máxima medida permitida por la ley:

  • 333 se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, ya sean expresas o implícitas.
  • No garantizamos que la App sea ininterrumpida, libre de errores o que cumpla sus expectativas específicas.
  • No seremos responsables por daños indirectos, incidentales, especiales, consecuentes o punitivos derivados del uso o la imposibilidad de uso de la App.
  • Nuestra responsabilidad total acumulada no excederá el monto pagado por usted en los últimos 12 meses.
  • No somos responsables de las decisiones que tome basándose en las respuestas de ALMA.

8. Indemnización

Usted acepta indemnizar y mantener indemne a Alama 333, sus directivos, empleados y agentes de cualquier reclamación, daño o gasto derivado de su uso de la App o violación de estos Términos.

9. Terminación

Podemos suspender o terminar su acceso a 333 si viola estos Términos o si es necesario por razones legales o de seguridad. Usted puede terminar su uso en cualquier momento eliminando su cuenta.

10. Modificaciones

Podemos modificar estos Términos en cualquier momento. Le notificaremos de cambios significativos a través de la App o por correo electrónico. El uso continuado de la App después de la notificación constituye su aceptación de los Términos modificados.

11. Ley Aplicable

Estos Términos se rigen por las leyes aplicables en la jurisdicción donde Alama 333 tiene su sede. Cualquier disputa se resolverá en los tribunales competentes de dicha jurisdicción.

Welcome to 333 (also known as ALMA). These Terms and Conditions ("Terms") govern your use of the 333 mobile application ("the App"), operated by Alama 333 ("we", "our", or "the Company").

By downloading, installing, or using 333, you agree to these Terms in their entirety. If you do not agree, do not use the application.

1. Service Description

333 is a personal growth and emotional wellness platform that offers:

  • Conversations with ALMA, an artificial intelligence assistant.
  • Guided personal journal.
  • Meditations and wellness exercises.
  • Habit tracking.
  • Courses and personal development content.
  • Emotional progress metrics.

2. Subscription and Payments

2.1 Price

333 requires a premium subscription at a cost of $12.99 USD per month.

2.2 Auto-Renewal

The subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.

2.3 Payment Processing

Payments are processed through Apple App Store or Google Play, depending on your device platform. We do not have direct access to your payment information.

2.4 Cancellation

You may cancel your subscription at any time through your account settings in App Store or Google Play. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

2.5 Refunds

Refunds are handled according to Apple's or Google's policies, as applicable. We do not process refunds directly.

3. Use of Artificial Intelligence — Important Notice

ALMA is NOT a mental health professional.

ALMA is an artificial intelligence assistant designed to support your reflection and personal growth process. ALMA:

  • Does NOT provide medical, psychological, or psychiatric advice.
  • Does NOT replace professional therapy or medical treatment.
  • Does NOT diagnose or treat mental health conditions.
  • Should NOT be used in crisis or emergency situations.

If you are in a crisis situation, contact your country's emergency services or a specialized helpline. ALMA is a complementary wellness tool, not a substitute for professional care.

4. User Content

4.1 Ownership

You retain all ownership rights to content you create in 333, including journal entries, reflections, and any text you write.

4.2 License

By using the App, you grant us a limited, non-exclusive, revocable license to store, process, and display your content for the sole purpose of providing the service. This license terminates when you delete your account.

4.3 AI Responses

Responses generated by ALMA are created by artificial intelligence and do not represent professional opinions or advice from Alama 333. These responses are provided "as is" without warranty of accuracy or suitability.

5. Acceptable Use

When using 333, you agree to:

  • Use the App in compliance with applicable laws.
  • Not attempt to manipulate or abuse the AI system.
  • Not use the App to generate illegal, harmful, or abusive content.
  • Not attempt to access other users' accounts.
  • Not reverse engineer or attempt to extract the source code.
  • Not use the App for unauthorized commercial purposes.
  • Not create multiple accounts to evade restrictions.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

6.1 Our Property

The App, including its design, code, branding, logos, editorial content, meditations, courses, and all related materials, are the property of Alama 333 or its licensors and are protected by intellectual property laws.

6.2 Restrictions

You may not copy, modify, distribute, sell, or create derivative works based on our content or the App without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law:

  • 333 is provided "as is" and "as available", without warranties of any kind, whether express or implied.
  • We do not guarantee that the App will be uninterrupted, error-free, or that it will meet your specific expectations.
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the App.
  • Our total cumulative liability shall not exceed the amount paid by you in the last 12 months.
  • We are not responsible for decisions you make based on ALMA's responses.

8. Indemnification

You agree to indemnify and hold harmless Alama 333, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Termination

We may suspend or terminate your access to 333 if you violate these Terms or if necessary for legal or security reasons. You may terminate your use at any time by deleting your account.

10. Modifications

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Continued use of the App after notification constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the applicable laws in the jurisdiction where Alama 333 is headquartered. Any disputes shall be resolved in the competent courts of that jurisdiction.
